Bankruptcy Litigation
Litigation in the bankruptcy courts is a rapidly growing part of our practice. We have litigated a variety of the complex and difficult issues created by the intervention of a bankruptcy filing in our clients' relationships with their borrowers and customers. We have successfully tried dozens of adversary proceedings and contested matters under the federal Bankruptcy Code which often involves an interplay with state law issues. We have likewise successfully appealed to District and Circuit-level appellate courts from adverse bankruptcy court rulings.

Lender Liability Defense
Action against lenders is a rapidly emerging type of litigation in Mississippi. We have successfully defended our clients against a barrage of such claims in the state and federal courts. We anticipate continued litigation of this type, and we are prepared to continue in our defense of our clients' interests in these cases.

Insurance Coverage
We are experienced insurance-defense counsel, and we are equally adept at making certain your insurance carrier fulfills its contractual duty to defend you when the need arises. Mississippi law has changed dramatically in recent years regarding an insured's right to choose his own attorney to defend his interests when he has been sued - at the expense of his insurance carrier. Many of our clients choose us to represent them when their insurance carrier "reserves its rights" to deny coverage or to withdraw its defense or when the amount of coverage is inadequate to the amount of the claims asserted against the insured.

Arbitration and Mediation
We are experienced in representing our clients' interests in resolving disputes outside the courtroom when practical. Arbitration is a means of submitting a dispute to an impartial arbiter who decides the case in a typically less contentious setting. Mediation, by contrast, is simply a means of settling claims through the use of a disinterested third party who tries to bring the parties to common ground to agree on a resolution. We are able to advocate for our clients' best interests in both arbitration and mediation. We have also prepared arbitration agreements that our clients use in their contractual relationships as a further protection from unwanted litigation.
